These Terms of Service constitute a legally binding agreement between you, the customer or user, and A Ray of Sunshine, doing business as Worlds Most Trusted Hosting, referred to in these Terms as “Worlds Most Trusted Hosting,” “we,” “us,” or “our.”
These Terms apply to all websites, hosting accounts, servers, domain names, email accounts, software, customer portals, support services, and other products or services that we provide.
1. Acceptance of Terms
By creating an account, submitting an order, clicking an acceptance button, paying an invoice, or accessing or using any Service, you agree to be bound by these Terms and any policies incorporated into them by reference.
If you use the Services on behalf of a business, organization, or other legal entity, you represent that you have authority to bind that entity to these Terms. In that case, “you” and “your” include both you and the entity.
2. Eligibility
You must be at least 18 years old and legally capable of entering into a binding contract to purchase or use our Services.
Our Services are not directed toward children under 13. You may not use our Services to knowingly collect personal information from children in violation of applicable law.
We may refuse service where permitted by law, including when we reasonably believe that an order is fraudulent, abusive, unlawful, technically unsafe, or likely to harm our systems or other users.
3. Our Services
Worlds Most Trusted Hosting may provide shared hosting, reseller hosting, virtual private servers, dedicated servers, domain name services, SSL certificates, email hosting, website migration, website tools, control-panel access, technical support, and other related services.
Features, storage, bandwidth, resource limits, support levels, software, pricing, and service specifications may vary by plan. The description displayed on the applicable order page or service page forms part of these Terms.
We may use third-party facilities, data centers, networks, registrars, software, control panels, payment processors, and service providers to deliver the Services.
4. Customer Accounts
You agree to provide complete, accurate, and current information when creating an account and to promptly update that information whenever it changes.
You are responsible for:
- All activity performed through your account;
- Maintaining accurate contact and billing information;
- Keeping usernames, passwords, and access credentials secure;
- Ensuring that authorized users comply with these Terms;
- Reviewing notices, invoices, and support communications; and
- Contacting us promptly if unauthorized access is suspected.
You may not create an account using false information, impersonate another person or business, or use another party’s payment method without permission.
We may require reasonable identity, contact, or payment verification before activating or continuing a Service.
5. Billing and Payment
5.1 Charges
You agree to pay all charges, taxes, renewal fees, usage charges, setup fees, recovery fees, administrative fees, and other amounts associated with the Services you order.
Unless otherwise stated, prices are listed in United States dollars. Applicable sales, use, value-added, or similar taxes may be added to your invoice.
5.2 Payment authorization
By providing a payment method, you authorize us and our payment processors to charge that method for initial purchases, recurring renewals, outstanding balances, and other authorized charges.
5.3 Payment deadlines
Invoices must be paid by the due date shown on the invoice. Services with unpaid balances may be suspended or terminated. Suspension does not cancel the outstanding balance.
5.4 Chargebacks and payment disputes
Before initiating a chargeback or payment reversal, you agree to contact our billing department and provide a reasonable opportunity for us to investigate.
Fraudulent or abusive chargebacks may result in immediate suspension or termination. You remain responsible for valid charges, collection costs, chargeback fees, and other amounts permitted by law.
6. Automatic Renewals
Services may automatically renew for additional billing periods unless you cancel them through the customer portal or another cancellation method approved by us.
You authorize us to charge your payment method on file for each renewal. Renewal pricing may differ from introductory, promotional, or first-term pricing.
You are responsible for reviewing renewal dates and maintaining a valid payment method. Failure to receive a reminder does not eliminate your responsibility to renew or cancel a Service.
Cancellation requests should be submitted before the next renewal date. Removing a payment method, allowing a card to expire, or failing to use a Service does not constitute cancellation.
7. Cancellations and Refunds
7.1 Cancellation requests
You may request cancellation through the Worlds Most Trusted Hosting customer portal or by contacting our billing department. For account security, we may require verification before processing a cancellation.
7.2 Hosting refund period
New customers purchasing an eligible shared web-hosting plan may request a refund of the basic hosting fee within 30 calendar days after the original purchase date, unless a different refund period is displayed during checkout.
The refund period applies only to the first qualifying hosting purchase made by a customer. Renewals, upgrades, additional accounts, and repeat purchases are not covered unless required by law or expressly stated otherwise.
7.3 Nonrefundable charges
Unless required by law, the following are nonrefundable:
- Domain registration, renewal, transfer, redemption, or recovery fees;
- SSL certificates and software licenses;
- Setup, installation, migration, or administrative fees;
- Virtual private servers and dedicated servers;
- Backup restoration or data recovery services;
- Third-party products or services;
- Usage-based, overage, or excess-resource charges;
- Services terminated for violations of these Terms;
- Promotional credits, account credits, and coupons;
- Chargeback, collection, or late-payment fees; and
- Cryptocurrency or other irreversible payments, where applicable.
If a free domain or other promotional item was included with a refundable hosting plan, its normal retail cost may be deducted from the refund.
7.4 Account credits
Account credits have no cash value, may not be transferred, and may expire as permitted by law. Credits may be applied only to eligible future purchases.
8. Domain Name Services
Domain registrations and transfers are subject to registry, registrar, ICANN, and country-code registry requirements, where applicable.
We do not guarantee that a requested domain name will be available or successfully registered until registration is confirmed by the applicable registry.
You are responsible for:
- Providing accurate domain registrant information;
- Keeping domain contact information current;
- Responding to verification requests;
- Renewing domains before expiration;
- Protecting registrar and transfer credentials;
- Ensuring that your domain does not violate third-party rights; and
- Complying with registry and registrar policies.
Expired domains may stop working immediately and may enter a grace, redemption, auction, deletion, or recovery period. Additional recovery fees may apply, and recovery is not guaranteed.
Domain names generally cannot be refunded, changed, or corrected after registration. You must verify spelling before submitting an order.
9. Acceptable Use
You may use the Services only for lawful purposes. You may not use, attempt to use, or permit another person to use our Services in a way that violates applicable law, these Terms, or the rights of another party.
Prohibited activities include, without limitation:
- Hosting, distributing, transmitting, or promoting unlawful content;
- Infringing copyrights, trademarks, patents, trade secrets, privacy rights, publicity rights, or other proprietary rights;
- Distributing malware, ransomware, viruses, spyware, malicious scripts, credential-stealing tools, or harmful code;
- Phishing, identity theft, impersonation, fraud, scams, or deceptive business practices;
- Unauthorized access, password attacks, port scanning, vulnerability scanning, network probing, or attempts to compromise any system;
- Operating botnets, denial-of-service attacks, traffic floods, or services intended to disrupt networks;
- Sending unsolicited bulk email, purchased-list email, harvested-address email, or messages that violate anti-spam laws;
- Hosting material that sexually exploits minors or depicts child sexual abuse;
- Publishing another person’s sensitive personal information without lawful authority;
- Making threats of violence, encouraging criminal conduct, or facilitating unlawful harm;
- Hosting pirated software, unauthorized media, counterfeit goods, or tools primarily intended to bypass licensing or access controls;
- Operating open proxies, public VPN services, file-sharing indexes, cryptocurrency mining, or similar high-risk services unless expressly authorized under your plan;
- Consuming excessive resources or interfering with other customers; or
- Attempting to avoid, defeat, or circumvent any restriction, suspension, security control, or resource limit.
We may investigate suspected violations and cooperate with courts, regulators, law-enforcement agencies, registries, upstream providers, and other authorized parties where legally required or reasonably necessary to protect our Services.
10. Resource Usage and Fair Use
Shared hosting is intended for ordinary website and email operation. It is not intended to provide unlimited computing capacity or to support activities that materially affect other customers.
Even when a plan is advertised with “unlimited” storage, bandwidth, websites, or email, use remains subject to reasonable technical limitations, fair-use requirements, and the intended purpose of the plan.
Examples of excessive or inappropriate use may include:
- Sustained high CPU, memory, disk, database, or process usage;
- Using hosting storage mainly for backups or personal file storage;
- Hosting large downloadable archives unrelated to a website;
- Running resource-intensive scripts, crawlers, bots, or cron jobs;
- Maintaining unusually large databases, logs, caches, or mailboxes;
- Generating traffic that degrades network or server performance;
- Running applications unsuitable for a shared environment; or
- Using resources in a way that threatens stability or security.
We may request that you reduce usage, optimize your account, remove files, upgrade to another plan, or move to a more appropriate service. In urgent situations, we may immediately restrict or suspend the affected service.
11. Email and Anti-Spam Rules
You may not use our Services to send unsolicited bulk or commercial email, whether the email is sent directly through our systems or promotes a website hosted on our systems.
Customers sending commercial email must:
- Have lawful permission to contact each recipient;
- Use accurate sender and routing information;
- Clearly identify commercial messages where required;
- Provide a functioning unsubscribe method;
- Honor opt-out requests promptly;
- Maintain evidence of consent when requested; and
- Comply with all applicable email and privacy laws.
Purchased, rented, scraped, harvested, or third-party mailing lists are prohibited unless you can establish lawful and verifiable recipient consent acceptable to us.
We may limit outbound email, block messages, suspend accounts, or require corrective action when email activity causes complaints, blacklisting, excessive bounces, delivery problems, security risks, or harm to our network reputation.
12. Security Responsibilities
You are responsible for maintaining the security of your websites, applications, scripts, databases, email accounts, devices, and login credentials.
Your responsibilities include:
- Using strong and unique passwords;
- Enabling multifactor authentication when available;
- Installing software and security updates promptly;
- Removing unsupported or unused applications and plugins;
- Restricting administrative access;
- Scanning devices and websites for malware;
- Maintaining independent backups; and
- Promptly reporting suspected compromises.
We may reset passwords, isolate files, disable applications, restrict traffic, quarantine email, or suspend a compromised account when reasonably necessary to protect customers, systems, or third parties.
Security assistance, malware removal, website repair, and recovery work may require a separate fee unless included in your plan.
13. Backups and Customer Data
You are solely responsible for creating, maintaining, testing, and securely storing current backups of all websites, databases, emails, account settings, and other data.
Any backup service we provide is offered as a convenience and is not guaranteed. Backups may be incomplete, unavailable, corrupted, delayed, overwritten, or excluded because of storage limits, account size, technical failure, maintenance, security events, or other circumstances.
You should maintain at least one recent backup in a location that is separate from our network and under your control.
After cancellation, expiration, suspension, or termination, data may be permanently deleted at any time. We have no obligation to retain or recover data after the Service ends.
14. Availability, Uptime, and Maintenance
We work to provide reliable Services, but no website, server, network, software system, or internet connection can be guaranteed to operate without interruption.
Service interruptions may result from:
- Scheduled or emergency maintenance;
- Hardware, software, network, or power failures;
- Cyberattacks or security incidents;
- Upstream network or data-center problems;
- Domain, DNS, registry, or third-party failures;
- Customer configuration or application errors;
- Legal or regulatory requirements; or
- Events outside our reasonable control.
Any uptime commitment or service credit applies only when expressly stated in a separate written Service Level Agreement. Service credits, when available, are the customer’s sole remedy for a qualifying availability failure.
15. Customer Support
Support is provided through the channels and during the hours described on our website or within the customer portal.
Support generally covers the hosting platform and Services we provide. Unless included in your plan, support does not include website design, custom programming, search optimization, software development, content management, third-party application repair, malware cleanup, or general computer training.
Response and resolution times are estimates unless guaranteed by a separate written agreement. Complex issues, third-party problems, security investigations, and vendor escalations may require additional time.
Customers must communicate respectfully with our staff. Threats, harassment, discriminatory abuse, or repeated abusive behavior may result in restricted support or termination.
16. Suspension and Termination
We may restrict, suspend, or terminate a Service when reasonably necessary, including for:
- Nonpayment or payment reversal;
- A violation of these Terms;
- Fraudulent or misleading account information;
- Illegal, abusive, or harmful activity;
- Excessive resource consumption;
- A security compromise or threat;
- A court order, subpoena, legal obligation, or government request;
- A complaint from a registry, provider, or rights holder;
- Risk to our systems, reputation, customers, or third parties; or
- Repeated failure to respond to important notices.
We may act without advance notice when immediate action is reasonably necessary to address fraud, abuse, security threats, illegal conduct, network instability, or possible harm.
Where appropriate, we may provide an opportunity to correct a violation. We are not obligated to restore a suspended or terminated Service.
Termination does not relieve you of payment obligations incurred before termination. Except where required by law, refunds are not provided when a Service is terminated for a violation of these Terms.
17. Website Migration Services
Complimentary or paid migration assistance is provided on a reasonable-effort basis. We do not guarantee that every website, account, database, email message, setting, certificate, or application can be transferred successfully.
Migration eligibility may depend on the source provider, available access, software compatibility, account size, server configuration, and technical condition of the source account.
You are responsible for reviewing and testing migrated websites, databases, email accounts, DNS records, forms, payment systems, and applications before canceling your former service.
18. Intellectual Property
You retain ownership of content that you lawfully upload to the Services. You grant us and our service providers a limited, nonexclusive license to host, store, copy, transmit, display, process, back up, and otherwise handle that content as reasonably necessary to provide and protect the Services.
You represent that you own or have permission to use all content, software, trademarks, images, data, and other materials placed on or transmitted through your account.
Our names, logos, website design, documentation, software, branding, graphics, and original materials are owned by or licensed to Worlds Most Trusted Hosting and may not be copied, modified, or used without authorization.
19. Copyright Complaints and DMCA Notices
Worlds Most Trusted Hosting respects intellectual-property rights. Copyright owners or their authorized agents may report allegedly infringing material hosted through our Services.
A copyright notice should include:
- Identification of the copyrighted work claimed to have been infringed;
- Identification and location of the allegedly infringing material;
- The complaining party’s name, mailing address, telephone number, and email address;
- A statement of good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law;
- A statement that the information in the notice is accurate and, under penalty of perjury, that the complaining party is authorized to act for the owner; and
- A physical or electronic signature of the authorized person.
We may remove or restrict access to allegedly infringing material and may terminate repeat infringers when appropriate.
Knowingly submitting a false or materially misleading copyright complaint or counter-notice may result in legal liability.
20. Third-Party Products and Services
Certain Services may include or rely on products supplied by registrars, certificate authorities, software vendors, data centers, control-panel providers, payment processors, content delivery networks, or other third parties.
Your use of a third-party product may be governed by that provider’s separate license, privacy policy, acceptable-use policy, or terms.
We are not responsible for third-party acts, omissions, outages, policy changes, product changes, pricing changes, security incidents, or discontinued services.
21. Disclaimer of Warranties
To the fullest extent permitted by law, the Services are provided “as is” and “as available,” without warranties of any kind, whether express, implied, statutory, or otherwise.
We disclaim all implied warranties, including warranties of merchantability, fitness for a particular purpose, noninfringement, title, accuracy, security, availability, and uninterrupted operation.
We do not warrant that the Services will be error-free, uninterrupted, completely secure, compatible with every application, or suitable for every purpose. We do not guarantee business results, website traffic, search rankings, sales, revenue, email delivery, or protection from every threat.
Some jurisdictions do not permit certain warranty exclusions. In those jurisdictions, exclusions apply only to the maximum extent permitted by law.
22. Limitation of Liability
To the fullest extent permitted by law, Worlds Most Trusted Hosting and its owners, officers, employees, contractors, affiliates, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages.
This limitation includes loss of profits, revenue, customers, business opportunities, goodwill, data, email, files, domain use, website availability, or anticipated savings, even if we were advised that such damages were possible.
To the fullest extent permitted by law, our total aggregate liability arising from or related to a Service will not exceed the amount you paid directly to us for the affected Service during the three months immediately preceding the event giving rise to the claim.
The limitations in this section apply regardless of the legal theory asserted and even if a remedy fails of its essential purpose.
Nothing in these Terms excludes liability that cannot lawfully be excluded or limited.
23. Indemnification
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Worlds Most Trusted Hosting and its owners, officers, employees, contractors, affiliates, licensors, and service providers from claims, damages, liabilities, judgments, losses, costs, and reasonable legal fees arising from:
- Your use or misuse of the Services;
- Your content, website, business, products, or communications;
- Your violation of these Terms or applicable law;
- Your infringement of another party’s rights;
- Activity conducted through your account; or
- A dispute between you and your users, customers, or business partners.
We may control the defense and settlement of an indemnified claim, and you agree to provide reasonable cooperation.
24. Changes to Services, Prices, and Terms
We may modify, replace, limit, or discontinue a Service, feature, software component, or plan when reasonably necessary for security, legal, operational, technical, or business reasons.
We may change pricing for future purchases and renewal periods. Updated prices generally take effect at the next renewal unless otherwise stated.
We may update these Terms periodically. The updated version will be posted on this page with a revised “Last updated” date. Material changes may also be communicated through the customer portal, by email, or through another reasonable method.
Your continued use of the Services after updated Terms become effective constitutes acceptance of those updated Terms. Changes will not be applied retroactively where prohibited by law.
25. Governing Law and Disputes
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.
Before filing a legal claim, each party agrees to make a good-faith effort to resolve the dispute informally. You may begin this process by emailing Support@worldsmosttrustedhosting.com with your name, account information, a description of the dispute, and the resolution requested.
Unless applicable law requires otherwise, any court proceeding must be brought in the state or federal courts located in Los Angeles County, California, and each party consents to the jurisdiction and venue of those courts.
26. General Provisions
26.1 Entire agreement
These Terms, the applicable order, plan description, Privacy Policy, Acceptable Use requirements, and any signed service agreement constitute the entire agreement concerning the Services.
26.2 Order of precedence
If a signed written agreement conflicts with these Terms, the signed agreement controls only to the extent of the conflict.
26.3 Severability
If any provision is found invalid or unenforceable, it will be modified to the minimum extent necessary, and the remaining provisions will remain effective.
26.4 No waiver
A failure to enforce a provision does not waive our right to enforce it later.
26.5 Assignment
You may not assign or transfer your account or rights under these Terms without our written consent. We may assign these Terms in connection with a merger, acquisition, corporate reorganization, sale of assets, or transfer of the Services.
26.6 Force majeure
We are not responsible for delay or failure caused by events outside our reasonable control, including natural disasters, severe weather, fire, war, civil disorder, terrorism, labor disputes, utility failures, internet failures, data-center incidents, cyberattacks, government actions, epidemics, or supply interruptions.
26.7 Electronic communications
You consent to receive agreements, invoices, notices, and other communications electronically. You are responsible for keeping your email address current and checking your customer account.
26.8 Survival
Provisions that by their nature should survive termination will remain effective, including payment obligations, intellectual property provisions, warranty disclaimers, liability limitations, indemnification, and dispute provisions.
